Overview

The Building Safety Regulator Legal Team is recruiting for a Senior Advisory and Enforcement Lawyer. The work of the Building Safety Regulator Legal Team is split into two areas - Regulation of the Building Profession (Reg of Prof) and Regulation of Higher-Risk Buildings (HRB). The HRB team ensures the safety of residents in occupied higher-risk buildings and provides legal advice in relation to BSR''s role as the building control authority for building work in HRBs, including criminal prosecutions and civil proceedings and appeals in the First Tier Tribunal. The Reg of Prof team advises on policies to ensure that those responsible for building control comply with legal, regulatory, and professional obligations, and provides legal advice during sanctions and disciplinary processes where needed. The government announced on 30 June 2025 that the Building Safety Regulator will become an Executive Agency of MHCLG and will move out of HSE; successful candidates recruited to this vacancy will initially be onboarded to HSE with a move to the new Executive Agency undertaken in due course.Responsibilities

Provide risk based legal advice to the organisation on the regulatory framework for BSR clients on a wide range of topics, including operational and policy issues.Handle your own caseload of criminal enforcement matters, with the emphasis on complex cases—providing advice on investigations, making the decisions to prosecute and conducting any resulting court proceedings.Respond to appeals (in the First Tier Tribunal) against enforcement notices issued by the BSR.Work with senior legal, operational and policy colleagues to implement and manage the enforcement of the BSR regime and contribute to shaping and designing new processes to support collaborative working.Contribute to work with legal professionals in the Government Legal Department on wider policy aspects of the BSR.Contribute to the devising and delivery of relevant legal training and the delivery of written legal guidance on the BSR''s remit.Contribute to the work of the LSD Senior Management Team.Line management of a team of Band 2 lawyers and paralegals as required.This post will require occasional travel to HSE''s headquarters in Bootle and other HSE offices, as well as occasional attendance at courts, case conferences and meetings nationwide, which may involve overnight stays.Requirements / Qualifications

Leadership skillsSound legal judgement and appreciation of legal riskThe ability to think strategically and creatively, appreciating legal issues in their wider context and advising accordinglyAnalytical skills, using secure legal research to produce timely and fit for purpose adviceThe ability to supervise and lead a team, including manage staff to achieve their full potential, through a period of change including case oversight and performance managementThe ability to build, maintain and manage relationships with internal colleagues and other regulators, and other government departmentsThe ability to quickly assimilate new areas of law with a keen interest in expanding your legal knowledge and skillsExperience of line managementExperience of Building SafetyExperience of Regulation of a Profession, LegalYou must be legally qualified – either a qualified Solicitor or Barrister. Academic: you must have a law degree or a non-law degree with CPE or GDL; you are eligible to apply if you have qualified as a solicitor or barrister through the CILEx route. Professional: you must have completed the LPC/SQE or BPTC and, where necessary, have completed the relevant pupillage or training contract, or have full exemption from the SRA or BSB. A valid practising certificate for England and Wales issued by the SRA or BSB or eligibility to hold one is required.Salary and Benefits
